These Terms of Service ("Terms") govern your use of NewBuildWire (the "Service"), operated from Texas, United States ("NewBuildWire," "we," "us"). By creating an account, subscribing, or using the Service, you agree to these Terms and to the Privacy Policy in Section 12. If you do not agree, do not use the Service.

NewBuildWire aggregates publicly available government records — building permits, permit applications, and related filings published by cities, counties, appraisal districts, and state agencies — and presents them as a feed, market pages, individual lead pages, and email alerts. The Service is an informational tool for business use. It is not a consumer reporting agency, does not provide consumer reports as defined by the Fair Credit Reporting Act (FCRA), and must not be used to evaluate any person's eligibility for credit, insurance, employment, housing, or any other purpose covered by the FCRA.

All permit and filing data in the Service comes from public government sources. Those sources contain errors, gaps, delays, duplicates, and jurisdiction-specific quirks, and we reproduce their content substantially as published.

5. Your outreach is your responsibility

Plain-English version: we give you public information about construction projects. How you contact anyone is on you, and you must follow the law when you do it.

If you contact any person or business identified through the Service, you are solely responsible for complying with all applicable laws and regulations, including without limitation the Telephone Consumer Protection Act (TCPA), federal and state Do-Not-Call registries and telemarketing rules, the CAN-SPAM Act, state privacy and telemarketing statutes, and any industry-specific rules that apply to you. In particular, you agree that you will not:

Names and contact details appearing in permit records (for example, a permit holder, property owner, or contractor of record) are reproduced from the public record and are provided as business information only. NewBuildWire makes no representation that any number or address is lawful to contact by any particular method.

7. Intellectual property

The underlying public records are not owned by anyone. Our selection, arrangement, normalization, scoring, enrichment, software, design, and branding are owned by NewBuildWire and protected by applicable law. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service and its data for your own internal business purposes during your subscription.

The Service links to and embeds third-party services, including government record portals, Google Maps, and our payment and email providers. Those services have their own terms and privacy practices, which we do not control.

9. Disclaimers and limitation of liability

To the maximum extent permitted by law: (a) NewBuildWire will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or lost data, arising out of or relating to the Service, even if advised of the possibility; and (b) our total aggregate liability for all claims arising out of or relating to the Service will not exceed the amounts you paid us in the twelve (12) months before the event giving rise to the claim (or $50 if you have paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

You will defend, indemnify, and hold harmless NewBuildWire and its owner, affiliates, and service providers from and against any claims, damages, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your outreach to any person or business identified through the Service, including any alleged violation of the TCPA, Do-Not-Call rules, CAN-SPAM, or similar laws; (b) your breach of these Terms; or (c) your use of the data in violation of law.
