Terms of Service & Privacy Policy

These Terms of Service ("Terms") govern your use of NewBuildWire (the "Service"), operated from Texas, United States ("NewBuildWire," "we," "us"). By creating an account, subscribing, or using the Service, you agree to these Terms and to the Privacy Policy in Section 12. If you do not agree, do not use the Service.
1. What the Service is
NewBuildWire aggregates publicly available government records — building permits, permit applications, and related filings published by cities, counties, appraisal districts, and state agencies — and presents them as a feed, market pages, individual lead pages, and email alerts. The Service is an informational tool for business use. It is not a consumer reporting agency, does not provide consumer reports as defined by the Fair Credit Reporting Act (FCRA), and must not be used to evaluate any person's eligibility for credit, insurance, employment, housing, or any other purpose covered by the FCRA.
2. Eligibility and accounts
- You must be at least 18 years old and using the Service for business purposes.
- Accounts are accessed by email sign-in link. You are responsible for maintaining control of your email account and for all activity under your NewBuildWire account.
- One account is for one person. Team, multi-seat, or company-wide use requires our written agreement.
3. Subscriptions, billing, and cancellation
- Paid plans are billed in advance on a recurring monthly (or, where offered, annual) basis through our payment processor, Stripe. We do not see or store your card number.
- Plans renew automatically until cancelled. You can cancel any time through the billing portal linked from your account; cancellation stops future charges and access continues through the end of the paid period.
- Except where required by law, payments are non-refundable, including for partial periods. If you believe you were billed in error, contact us within 30 days and we will review it in good faith.
- We may change prices with at least 14 days' notice; changes apply from your next billing cycle.
- Free previews and trials may be modified or withdrawn at any time.
4. The data: what it is and what we promise (and don't)
All permit and filing data in the Service comes from public government sources. Those sources contain errors, gaps, delays, duplicates, and jurisdiction-specific quirks, and we reproduce their content substantially as published.
- As-is. The Service and all data are provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose.
- Verify before acting. Always verify any record at the official government source (linked from each lead where available) before making business decisions based on it.
- No guaranteed results. We do not promise any volume of records, any number of leads, or any business outcome from using the Service.
- Coverage changes. Government data feeds appear, change, and disappear outside our control. We may add, modify, or remove data sources and markets at any time.
5. Your outreach is your responsibility
Plain-English version: we give you public information about construction projects. How you contact anyone is on you, and you must follow the law when you do it.
If you contact any person or business identified through the Service, you are solely responsible for complying with all applicable laws and regulations, including without limitation the Telephone Consumer Protection Act (TCPA), federal and state Do-Not-Call registries and telemarketing rules, the CAN-SPAM Act, state privacy and telemarketing statutes, and any industry-specific rules that apply to you. In particular, you agree that you will not:
- use auto-dialers, robocalls, prerecorded or artificial-voice calls, or automated text messaging to numbers obtained from or through the Service without the consent required by law;
- call numbers listed on the National Do-Not-Call Registry or any state registry where prohibited;
- send commercial email that does not comply with CAN-SPAM (accurate headers, physical address, working unsubscribe);
- represent to any recipient that NewBuildWire authorized, endorsed, or is responsible for your outreach.
Names and contact details appearing in permit records (for example, a permit holder, property owner, or contractor of record) are reproduced from the public record and are provided as business information only. NewBuildWire makes no representation that any number or address is lawful to contact by any particular method.
6. Acceptable use
You agree not to:
- resell, redistribute, republish, sublicense, or provide the Service's data to any third party, whether raw or repackaged, except for insubstantial excerpts used in your own ordinary business communications (for example, referencing a project in a sales email);
- scrape, crawl, bulk-download, or systematically extract data from the Service, or access it by any automated means other than features we provide;
- share account access, circumvent the free-preview limits, paywall, or any technical restriction;
- use the Service to build or train a competing product or dataset;
- use the Service for any unlawful purpose, including harassment, stalking, discrimination, or any FCRA-covered purpose (Section 1);
- interfere with the operation or security of the Service.
We may suspend or terminate accounts that violate this section, with or without notice, without refund.
7. Intellectual property
The underlying public records are not owned by anyone. Our selection, arrangement, normalization, scoring, enrichment, software, design, and branding are owned by NewBuildWire and protected by applicable law. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service and its data for your own internal business purposes during your subscription.
8. Third-party services
The Service links to and embeds third-party services, including government record portals, Google Maps, and our payment and email providers. Those services have their own terms and privacy practices, which we do not control.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law: (a) NewBuildWire will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, or lost data, arising out of or relating to the Service, even if advised of the possibility; and (b) our total aggregate liability for all claims arising out of or relating to the Service will not exceed the amounts you paid us in the twelve (12) months before the event giving rise to the claim (or $50 if you have paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnification
You will defend, indemnify, and hold harmless NewBuildWire and its owner, affiliates, and service providers from and against any claims, damages, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your outreach to any person or business identified through the Service, including any alleged violation of the TCPA, Do-Not-Call rules, CAN-SPAM, or similar laws; (b) your breach of these Terms; or (c) your use of the data in violation of law.
11. Termination, changes, governing law
- You may stop using the Service and cancel at any time. We may suspend or terminate the Service or your access for breach, non-payment, legal risk, or discontinuation of the product, and will refund any prepaid amounts only where required by law or where we discontinue the entire Service mid-period.
- We may update these Terms; material changes will be notified by email or in-product notice at least 14 days before taking effect. Continued use after the effective date is acceptance.
- These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Courts located in Texas have exclusive jurisdiction, and both parties consent to venue there. Before filing any claim, both parties agree to attempt informal resolution by email for 30 days.
12. Privacy Policy
This section describes what we collect from you as a user of the Service and how we use it.
What we collect
- Account data: your email address, chosen markets, and subscription status.
- Usage data: pages and leads viewed, searches, email opens/clicks, device and log information (IP address, browser), collected directly and through cookies or similar technologies, including analytics and advertising tags.
- Payment data: handled by Stripe. We receive subscription status and the last 4 digits/brand of your card, never the full number.
How we use it
- To operate the Service: sign-in links, alert emails for your markets, billing, support.
- To improve the Service: analytics on which markets, lead types, and features are used.
- To communicate with you: service notices, and marketing about NewBuildWire and other products operated by us (such as our other lead-alert services). Every marketing email includes a working unsubscribe, honored promptly; service emails (receipts, sign-in links, legal notices) are sent regardless.
- To advertise our own services: we may use cookies/pixels and share hashed identifiers with advertising platforms (for example, Google or LinkedIn) to measure our ads and reach audiences similar to our users.
- To publish aggregate insights: we may create and publish statistics and market research derived from usage and permit data (for example, "most-watched project types in DFW this month"). Aggregate insights never identify you, your company, or your account activity individually.
What we do not do
- We do not sell or rent your name, email address, or other personal information to third parties.
- We do not disclose your individual usage (what you viewed or which leads you opened) to anyone outside NewBuildWire and our service providers, except as required by law.
Sharing
We share personal data only with service providers who process it for us (hosting, email delivery, payments, analytics, advertising measurement) under their own confidentiality obligations; in connection with a merger, acquisition, or sale of the business (your data would transfer with the Service, subject to this policy); and where required by law or to protect our rights.
Retention, security, and your choices
- We retain account data while your account exists and for a reasonable period afterward for legal and accounting purposes, then delete or anonymize it.
- Data is stored with reputable cloud providers using industry-standard safeguards; no system is perfectly secure.
- You can unsubscribe from marketing at any time, request a copy of your personal data, or request deletion of your account and data by emailing us. We honor verified requests within 30 days, subject to legal retention requirements.
- We do not knowingly collect data from anyone under 18; the Service is for business users.
